Creator & Contributor Agreement

Framework for Creators and Contributors

Simple version: Creators stay independent owners of their stories. Uploading gives Peakovels permission to show and promote the story, but not to make anime/comics without a separate contract. You can earn from Support and also from performance-based programmes if your story does well.

2.1 Status of Creators & Contributors

Creators (writers, authors, illustrators, designers) and Contributors (collaborators, co-writers, etc.) using Peakovels are independent individuals or entities.

Unless explicitly stated by a separate written contract, they are not employees of the Company.
No partnership, agency, or joint venture is created.
The relationship is that of platform + independent creator.

2.2 Onboarding & Account Requirements

To publish or receive payouts, Creators must:

Create a valid Peakovels account,
Provide accurate identity and contact information,
Agree to this Legal Package and any additional Creator-specific terms.

Underage creators (if allowed) may require parent/guardian consent for formal contracts and payouts; Legal guardian as the payee in accordance with local law.

2.3 Content Submission & Baseline License

By uploading or submitting any Work (novel, chapter, art, character sheets, etc.), the Creator:

Confirms they have the full right to submit the Work;
Grants the Company a non-exclusive, worldwide, royalty-free license to:
• Host and display the Work,
• Make it accessible to users,
• Use excerpts for marketing and promotional purposes (banners, trailers, posts, etc.),
• Perform internal analytics.

This baseline license does not transfer copyright to the Company and does not grant adaptation rights (e.g., comics, anime, merch) unless a separate Adaptation / Licensing Agreement is signed for that specific Work.

2.4 Creator Warranties & Responsibilities

Creators warrant that:

The Work is original and not plagiarised.
The Work does not breach any prior publishing or exclusivity contracts.
The Work is not primarily AI-generated content fraudulently claimed as human-authored.
The Work does not violate laws (no illegal content, abuse, child exploitation, etc.).
They will respect community rules, including no harassment, no hate content.

The Company may remove, suspend, or terminate accounts and withhold earnings associated with fraudulent or unlawful content, subject to law.

2.5 Performance-Based Payments (Non-Support)

In addition to Support earnings, the Company may offer Creator payouts based on performance programmes and FANOA selection.

Performance metrics may include, in combination:

Total reads / views & monthly growth,
Completion rates and retention curves,
Engagement (likes, comments, saves, shares),
Quality ratings from readers,
Internal editorial scoring (plot, originality, consistency),
Community influence (fan discussion, organic hype),
Interest from external production partners.

Performance-based payouts are discretionary, based on available budgets and programme rules; Do not create guaranteed minimum earnings unless clearly specified in a separate contract (e.g., MG agreement); Are separate from Support Contributions.
